These Terms of Service ("Terms") constitute a legally binding agreement between you and Abu El Hag Gold Trading Company ("Company," "we," "us," or "our"), located at Building A1, Office No A1-221, Ajman Free Zone, Ajman, UAE.

By accessing our website or using our gold trading services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

2. Eligibility

To use our services, you must:

• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our services under UAE Federal Law or any other applicable law
• Provide accurate, current, and complete information during registration
• Successfully complete our Know Your Customer (KYC) verification process

• Gold bullion trading (buying and selling)
• Secure gold storage in our Ajman Free Zone facility
• Market analysis and advisory services
• Gold investment program management

All services are subject to availability and our acceptance of your order. We reserve the right to refuse service to anyone for any reason at any time.

4. Account Registration and Security

4.1 Account Creation

To purchase gold or use our storage services, you must create an account. You agree to provide accurate information and keep your account information up to date.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Use a strong, unique password
• Not share your account with others
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

5. Gold Trading Terms

5.1 Pricing

Gold prices are based on real-time spot market rates and may fluctuate. Prices displayed on our website are indicative and subject to change. Final transaction prices are confirmed at the time of order execution.

5.2 Orders and Payment

All orders are subject to our acceptance. We reserve the right to cancel or refuse any order. Payment terms will be specified for each transaction. Full payment is required before delivery or storage of gold bullion.

5.3 Delivery and Storage

You may choose to:

• Take physical delivery of purchased gold (subject to security protocols)
• Store gold in our secure Ajman Free Zone facility (storage fees apply)

Storage terms and fees will be outlined in a separate Storage Agreement.

5.4 Authenticity Guarantee

We guarantee that all gold bullion sold by us meets international purity standards of 99.99% and comes with proper certification documentation.

6. Investment Risks

Gold trading and investment involve risks. You acknowledge and agree that:

• Gold prices can fluctuate significantly
• Past performance does not guarantee future results
• You may lose some or all of your investment
• Our market analysis is for informational purposes only, not financial advice
• You should consult with a qualified financial advisor before making investment decisions

7. Fees and Charges

We charge fees for certain services, including but not limited to:

• Storage fees (monthly or annual)
• Transaction fees (may apply to buying/selling)
• Delivery and insurance fees
• Wire transfer or payment processing fees

All applicable fees will be disclosed to you before you complete a transaction. Fees are subject to change with 30 days' notice.

8. Compliance and Regulations

8.1 KYC/AML Requirements

We are required to comply with UAE Federal Law and Ajman Free Zone regulations regarding Know Your Customer (KYC) and Anti-Money Laundering (AML). You agree to provide all requested documentation for identity verification and source of funds verification.

8.2 Prohibited Activities

You agree not to use our services for:

• Money laundering or financing of terrorism
• Fraud or any illegal activities
• Violating any applicable laws or regulations
• Providing false or misleading information

9. Intellectual Property

10. Limitation of Liability

• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Abu El Hag Gold Trading Company, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms.

12. Termination

We may suspend or terminate your account and access to our services at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Request from law enforcement or regulatory authorities

Upon termination, you must settle all outstanding obligations. Stored gold will be returned to you according to our withdrawal procedures.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates and the regulations of Ajman Free Zone. Any disputes arising from these Terms or your use of our services shall be resolved through:

1. Good faith negotiations between the parties
2. Mediation if negotiations fail
3. Arbitration in Ajman, UAE, under UAE arbitration laws if mediation is unsuccessful

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
